After the Clarity Act failed a Senate procedural vote on Sept. 15, the SEC and CFTC moved within two days to build crypto rules under existing authority. The SEC created a temporary pathway for trading tokenized stocks; the CFTC sent a crypto rulemaking proposal to the White House. State attorneys general also pushed back, urging the Senate to preserve state powers.
