Kerala Court Backs Government Use of Patented Drugs

The Kerala High Court ruled Monday that the government may intervene when patented medicines are prohibitively priced, directing the Centre to collect nationwide affordability data for abemaciclib and ribociclib, two breast cancer drugs from Eli Lilly and Novartis. The court said Section 100 of the Patents Act could be invoked, but left the decision and timeline to the government.
